1. Acceptance and Purpose
Welcome to Cardapage. By accessing the website cardapage.com, using our management dashboard, scanning our QR codes or placing orders through our infrastructure, you expressly agree to these Terms and Conditions of Use.
Cardapage is a technology platform that provides interactive digital menu services, real-time order management (KDS — Kitchen Display System), routing of orders to rooms, tables and cabins, and operational optimization tools for hospitality and food service venues.
2. Registration and Responsibilities of the Venue
To use the management features, the venue must register a business account, providing truthful, complete and up-to-date information (legal name, trade name, CNPJ/tax ID, address and details of the person responsible).
- Safeguarding credentials: The venue is solely responsible for keeping its login details, passwords and access keys confidential, and answers for all activity carried out under its account.
- Accuracy of menu information: It is the venue's exclusive responsibility to ensure that dish descriptions, ingredients, allergens, stock availability, prices and fees are strictly correct and up to date.
- Regulatory compliance: The venue undertakes to comply with the health authority rules, consumer protection code and labor laws applicable to the food service and hospitality sector.
3. The Customer and Guest Experience
Cardapage was designed around the premise of Zero Friction: customers and guests can access the menu and submit orders directly from their phone's browser by scanning a QR code, with no need to download an app or create an account beforehand.
By submitting an order, the customer acknowledges that:
- Orders placed are transmitted immediately to the production system (kitchen, pantry or bar) of the respective venue.
- The identification of the room, table or cabin comes from the QR code scanned or from the information provided by the user at the time of submission.
- Any change or cancellation of an order after it has been sent must be handled directly with the venue's service staff.
4. Plans, Billing and Subscriptions (SaaS)
Cardapage is sold as Software as a Service (SaaS), with plans that vary according to the number of service points (tables, rooms, cabins), operational users and advanced features.
- Recurring subscription: Charges are made monthly or annually, according to the billing period selected at signup, by credit card, boleto or Pix.
- Additional points: Service points beyond the allowance of the plan contracted are charged proportionally on the following invoice.
- Zero commission on sales: Cardapage does not charge a percentage or fee on the revenue from orders placed in the dining room or as room service.
- Late payment: A payment delay of more than 10 (ten) calendar days may result in the temporary suspension of access to the administrative dashboard and the operation screens.
5. Intellectual Property and Licensing
All software, trademarks, logos, layouts, interfaces, source code, databases and graphic elements associated with Cardapage are the exclusive property of the platform and are protected by intellectual property and copyright laws.
We grant the venue a limited, non-exclusive, non-transferable and revocable license to use the platform for the duration of the subscription. The venue retains full ownership of its own data, brands, product images and content uploaded to the system.
6. Service Level (SLA) and Availability
We employ the highest standards of cloud infrastructure and redundancy to meet an availability target of 99.8% per month.
Any scheduled maintenance will be announced in advance and carried out preferably during periods of lower operational traffic. We are not responsible for unavailability caused by failures in the venue's internet connection, instability of telecommunications carriers, or force majeure.
7. Limitation of Liability
Cardapage acts as the provider of the intermediating technology platform. Accordingly:
- Preparation and quality: The preparation of dishes, the origin of ingredients, hygiene, temperature, taste and respect for dietary restrictions are the full responsibility of the supplying venue.
- Delivery and service: The delivery time to the room or table, the conduct of the floor staff and the final settlement of the bill belong exclusively to the relationship between the guest/customer and the venue.
- Local prices and charges: Any disagreement about amounts, discounts granted or service fees must be resolved with the venue's management.
8. Privacy and Data Protection (LGPD)
The processing of personal data carried out through Cardapage strictly observes the Brazilian General Data Protection Law (Federal Law No. 13,709/2018 - LGPD) and international best practices in information security.
For detailed information on collection, use, storage and the rights of data subjects, see our Privacy Policy, which forms part of these Terms for all purposes.
9. Cancellation and Termination
The venue may cancel its subscription at any time through the control panel or by contacting our support, with no termination penalties for monthly plans.
After a cancellation request, access remains available until the end of the period already billed. If requested, the registered data and menus may be exported by the venue before final deactivation.
10. Changes to These Terms
We may update these Terms from time to time to reflect product improvements, new features or changes in applicable law. In the event of substantial changes, we will notify venues by email or by a prominent notice in the administration dashboard at least 15 (fifteen) days in advance.
11. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil. The courts of the District of São Paulo/SP are chosen as the venue, expressly waiving any other, however privileged, to resolve any doubts or disputes arising from this instrument.
